Terms of Use
Please read these Terms of Service (hereinafter - "Terms") carefully before using the Lingotics Platform and/or Services as described below. If you do not agree to some or all of these terms, you should not become a member of and use the Platform of LINGOTICS EĞİTİM TEKNOLOJLERİ LİMİTED ŞİRKETİ (hereinafter referred to as "lingotics") located at EGITIM MAH. AHSEN ÇIKMAZI SK. ERDEMLER IS MERKEZI NO: 2 IÇ KAPI NO: 12 KADIKÖY/ ISTANBUL, established under the laws of the Republic of Turkey.
1-General
1-a) Terms of Use
These terms and conditions of use will apply if you subscribe to and use the subdomains www.lingotics.com, (hereinafter referred to as the website) lingotics.com.
You agree that you will be deemed to have accepted these terms and conditions as of the date and time you become a member of the website and that a contract is made between you and Lingotics within the framework of these terms and conditions.
These terms include: cancellation-refund policy, payment terms, privacy policy, cookie policy. These terms and policies are a legally binding agreement between the User (as defined below) and all visitors to or members of the Lingotics platform.
1-b) Lingotics Services
Access and use of the Lingotics platform is as follows 1- a user who has completed the registration process to receive online foreign language speaking services through the Lingotic platform (referred to below as "Student") 2- a user who has completed the registration process to provide online foreign language speaking services (referred to below as "Instructor") 3- a visitor who uses lingotics.com or the subdomains listed above but has not become a member.
Within this scope, by accepting this agreement; You are deemed to have accepted that you are a Student, Instructor or Visitor (each will be referred to as USER).
Lingotics services include the provision of online foreign language speaking training services by providing access to the Student and Instructor on the Lingotics platform, facilitating payments between the Student and Instructor on both sides and providing customer service. Lingotics does not provide online foreign language speaking training and services. Users are responsible for the provision of Internet access and the purchase of the necessary equipment to establish a connection and the installation of the necessary communication applications. By accepting this agreement, you agree that Lingotics may, if necessary, change the service processes and other flows in order to improve the Lingotics platform.
1-c) Changes to be made from these terms
In the event that the website is revised or significant changes are made to the terms of use, we will notify you of these changes by e-mail and we reserve the right to make these changes. We recommend that you accept this page regularly. You can find the latest versions of all agreements on this page. If you inform us that you want to delete your account by filling out the form on our website, we will delete your account immediately.
If you continue to use the Service despite the change in the Terms, you agree to be bound by the Terms and Policies.
2- Liabilities
2-a) Service Access
In order to use the services offered by the Lingotics platform, you must be over 18 years of age. Users under the age of 18, but not under the age of 13, can only use the Lingotics platform with the permission and presence of their parents. Parents must be present and accompany the user in all his/her activities on the platform.
By accepting this agreement, users who are under the age of 18 and under the age of 18 agree to be accompanied by their parents during the training process.
2-b) Verification Obligation
Lingotics initiates a 4-step process during the registration process of the Trainer, the Trainer is obliged to provide real information when uploading the profile photo and the video in which he/she will explain his/her work experience. The face of the person in the photo and video must match visually exactly.
All information entered by the tutor during these processes is checked by the Lingotics Tutor Management Team. Lingotics Instructor Management Team may request identification documents such as ID cards and similar documents issued by official institutions to verify the identity. In addition, if deemed necessary, the Lingotics Instructor Management Team may request an online interview. The instructor agrees that all this information will be provided accurately.
In messaging and online conversation trainings between users, personal information should not be shared, politics and politics should not be discussed, racism and similar discourses should not be made, opinions should not be expressed and actions should not be taken on prohibited topics and issues contrary to the law. In the event of the above-mentioned and not limited situations and events, Lingotics and its stakeholders are not legally and indemnifiably liable.
2-c) Confidentiality
If any of the matters in paragraph 2 above occur, Lingotics Customer Service should be contacted immediately.You may use the Lingotis Platform without providing personally identifiable information. You may be asked to provide personal data when using some services. Please refer to the Lingotics Privacy Policy for more information.
2-d) Payment
Payments you make on the Lingotics platform are received through payment systems provided by 3rd party payment providers, including but not limited to banks. The fee for the tuition received by the student is securely transferred to the tutor's account by Lingotics using these payment providers. It is Lingotics' obligation to send the tutor's tuition fee in full. Lingotics is responsible for any liability and compensation arising from this.
2-e) Refund
Lingotics is aware that it is obliged to ensure the safety of Students and Teachers in financial matters. For payments made outside of Turkey without using Turkish banks, the user is responsible for the transaction and transfer fees that will arise while refunding the User. For refund and cancellation procedures, please refer to the refund and cancellation policies page.
3- Your Rights and Limitations
3.a-) User Accounts
Some of the services available on the Lingotics platform are only available to registered users. You agree that you are responsible for protecting your account credentials from unauthorized use and that you are responsible for all activities that occur under your account credentials. You agree to notify us if you believe that any of your account credentials have been or may be used without your consent.
A user may only have one account and it is forbidden to open more than one account. You agree that if this is detected, your account will be closed and you will be removed from the system.
If you have uploaded a photo to your account or completed the registration process (google) with a 3rd party application, you are deemed to have accepted by accepting this agreement that you use it in your profile and information and accordingly it can be used on the Platform
As an instructor, you agree that the video and photo you upload can be used where students will see them.
3-b) Declarations and Commitments
By accepting the user agreement for instructor users;
You agree and undertake that you will provide online foreign language conversation training in accordance with Lingotics' policies and agreement
You agree and undertake to provide online foreign language conversation training in accordance with the laws, regulations and obligations of the country of residence registered in your account.
You agree and undertake to provide online foreign language speaking training within the scope of the guidelines and methodology prepared by the Lingotics Education Management Team and to take the necessary care.
You agree and undertake that you have submitted the necessary documents and information to provide online foreign language speaking training.
You agree that Lingotics may improve the image quality of the video you upload as a profile video if it deems necessary and may use its logo on the video in some areas.
By accepting the user agreement for users;
You agree to treat instructor users with due respect
In the comments to be written to the trainers, you agree that you will write realistic comments away from manipulation and commentary, and that you will not write comment content that will contain harassment and swearing.
4. MISCELLANEOUS PROVISIONS
4-a) Evidence contract: The Member agrees that the official books and commercial records of SA and the e-archive records, electronic information and computer records kept in the database and servers of LINGOTICS will constitute binding, conclusive and exclusive evidence in disputes that may arise from this Membership Agreement and that this article is an evidence contract within the meaning of Article 193 of the Code of Civil Procedure No. 6100.
4-b) Applicable Law and Dispute Resolution;This Membership Agreement shall be exclusively governed by the laws of the Republic of Turkey. Any dispute arising out of or in connection with this Membership Agreement shall be under the exclusive jurisdiction of Istanbul Consumer Arbitration Committees and Istanbul (Çağlayan) Courts and Enforcement Directorates.
4-c) Notification; LINGOTICS will communicate with the Member via the e-mail address provided by the Member when registering or by making calls and sending SMS to the phone number. The Member is obliged to keep his/her e-mail address and phone number up to date.
4-d) Integrity and Severability of the Membership Agreement; This Membership Agreement constitutes the entire agreement between the Parties regarding the subject matter. In the event that any provision of this Membership Agreement is held to be invalid or unenforceable or unreasonable in whole or in part by any competent court, arbitration panel or administrative authority, this Membership Agreement shall be deemed severable to the extent of such invalidity, unenforceability or unreasonableness, and the other provisions shall remain in full force and effect.
